Terms and Conditions
Terms and Conditions
Horizon Finance Limited trading as Finance.gi
1 Introduction
1.1 Scope
These Terms and Conditions govern use of the Finance.gi website and our general application and service arrangements. Horizon Finance Limited trades as Finance.gi. In these Terms, “we”, “us” and “our” refer to Horizon Finance Limited.
1.2 Your credit agreement
Each loan is subject to a separate credit agreement setting out its particular terms. Browsing the website, submitting an enquiry or receiving an illustration does not itself create a loan agreement. These website Terms do not replace the information or agreement supplied for your loan.
1.3 Consumer rights
Nothing in these Terms removes any rights or remedies you have under applicable law. Mandatory legal requirements take priority. Subject to those requirements, your specific credit agreement takes priority over these general Terms if they conflict.
1.4 Commencement
This version takes effect when published and applies prospectively. Publication does not retrospectively change an existing credit agreement, impose new charges on an existing loan or determine an existing complaint.
2 Definitions
2.1 “Customer”, “you” and “your” mean the individual or organisation using our website or applying for or receiving our services. A “consumer” is an individual acting outside their trade, business or profession.
2.2 “Services” mean the financial products and related services we offer. A “credit agreement” is the individual loan contract between you and Horizon Finance Limited, including its repayment schedule and any validly agreed variations.
2.3 “Retailer” means a supplier that introduces customers to us or assists with a finance application. “Content” means the text, images and other material on our website. A “durable medium” allows information addressed to you to be stored and reproduced unchanged, for example a paper copy or a PDF sent to you.
3 Use of the site and services
3.1 Eligibility
Individual applicants must be at least 18 and resident in Gibraltar. Business applicants must meet the eligibility criteria for the relevant product and apply through an authorised representative. Approval remains subject to our assessment and applicable law.
3.2 Account information
Where registration is required, provide accurate and current details. Keep your login information secure and tell us promptly if you suspect unauthorised access. You are not automatically responsible for activity outside your control.
3.3 Permitted use
Use the website lawfully. Do not submit fraudulent documents, impersonate another person, interfere with security or introduce harmful software. We may restrict website access where reasonably necessary to protect customers or our systems. This does not remove your access to loan information or your ability to make a complaint.
4 Loan applications and agreements
4.1 Application and approval
An application does not guarantee finance. We may request further information and approve, decline or offer different terms following our assessment. We will provide any information about our decision that the law requires.
4.2 Accuracy
You must provide information that is true, complete and accurate to the best of your knowledge. Tell us about any material change before the agreement is completed. A person applying for an organisation must have authority to do so.
4.3 Checks
We may undertake identity, affordability, creditworthiness, fraud prevention and other required checks, using information you provide and appropriate third parties. Our Privacy Policy explains how we process and share personal information. We obtain separate consent where required; accepting these Terms is not blanket consent to every use of your data.
4.4 Interest and the cost of finance
Our finance carries interest unless an interest-free offer is expressly confirmed by us and reflected in your credit agreement. Descriptions such as “buy now pay later”, “spread the cost” or “monthly payments” do not, by themselves, mean that borrowing is interest-free. The cash price of goods and the total payable under a finance agreement may differ.
4.5 Your individual offer
Before you are bound, we will provide the required information about your offer, including the amount financed, interest rate and calculation basis, APR where applicable, term, repayment amounts and dates, total payable and relevant fees. A flat annual interest rate is different from an APR. The method and figures applicable to your loan will be explained in its documents.
4.6 Information before signing
For consumer credit, we will provide the required pre-contract information in good time, in the prescribed form and on a durable medium, together with adequate explanations. You must have a meaningful opportunity to review the proposed agreement and ask questions before deciding whether to sign. A general website link does not replace information we are required to supply to you.
4.7 Reviewing the agreement
You should read the full agreement and repayment schedule before signing, check the figures and ask about anything you do not understand. If you cannot access the full document, need more time or receive conflicting information, tell us before proceeding. Do not sign until you are ready to accept the terms. We will provide a copy of the completed agreement free of charge.
4.8 Signing
Your signature records acceptance of the agreement, subject to applicable law. Choosing not to read a document that was properly provided does not, by itself, establish that the agreed interest is refundable. Equally, a signature is not a waiver of statutory rights or conclusive proof that every required disclosure or explanation was provided. We assess disputes using the relevant evidence.
4.9 Retailer applications
A retailer may introduce you to us and assist with the application or signing process. Unless we expressly authorise it, the retailer cannot approve credit, waive interest or change our offer. Tell us promptly if the retailer describes terms that differ from your documents. Retailer involvement does not exclude any legal responsibility we have for the information, explanations or representations provided in arranging finance.
4.10 Goods and credit
The retailer supplies the goods and is ordinarily the first contact for delivery, product quality or warranty issues. Your credit agreement governs repayment and any agreed security. Nothing here excludes a claim you may lawfully have against Horizon Finance Limited in connection with a linked purchase or retailer conduct.
5 Repayments fees and customer rights
5.1 Repayment schedule
Pay the amounts on the dates and by the method stated in your agreement, including any first instalment payable in store. We will identify whether an initial payment is a deposit or a loan repayment and explain how it affects the amount financed and remaining schedule. Keep your payment details up to date.
5.2 Charges
Interest, fees and the circumstances in which charges may arise must be disclosed as required before you agree. We will only apply charges that are permitted by law and properly form part of your agreement. These website Terms do not introduce additional loan fees.
5.3 Records and rounding
We will keep records of payments and provide account information as required. Where instalment rounding would produce a different total from the agreed amount payable, we will reconcile the difference through an adjusted payment, credit or refund as appropriate. Tell us if you believe a payment has been missed or incorrectly allocated.
5.4 Financial difficulty
Contact us promptly if you expect difficulty making a payment. We will review the information you provide and discuss available options. Any agreed change to payments will be confirmed in writing. Missed payments may lead to disclosed charges or recovery action only where permitted by the agreement and applicable law.
5.5 Withdrawal
Where a statutory right to withdraw applies, your agreement will explain the applicable period, how to exercise the right and any repayment obligations. These Terms do not shorten that period or create a cancellation fee. Withdrawing from credit does not necessarily cancel the purchase of the goods.
5.6 Early repayment
Where applicable, you may repay early in full or in part and receive the reduction in the cost of credit required by law. Ask us for a settlement calculation. Any permitted compensation will be explained and calculated within the applicable legal limits.
6 Intellectual property
6.1 Ownership
Website content belongs to Horizon Finance Limited or its licensors unless stated otherwise. Copyright, trade mark and other intellectual property rights are reserved.
6.2 Permitted copies
You may access the website and save or print information for your own personal use or legitimate consideration of our business services. You may retain and use your loan documents to exercise your rights. Other copying, commercial reuse or modification of our content requires permission unless permitted by law.
7 Privacy and data protection
7.1 Personal information
Our Privacy Policy explains the purposes and lawful bases for processing personal data, recipients, retention arrangements and your rights. Please read it alongside these Terms. Where a retailer collects information, its privacy notice may also apply to its own processing.
7.2 Communication preferences
Service communications and direct marketing are treated separately. Agreeing to electronic account communications does not, by itself, authorise marketing. Your data protection rights are unaffected by these Terms.
8 Liability
8.1 Our responsibility
We are responsible for loss or damage caused by our breach, negligence or other wrongful conduct to the extent provided by applicable law. Your remedies depend on the circumstances and any applicable legal requirements.
8.2 Rights that cannot be excluded
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Statutory consumer remedies remain available.
8.3 Website availability
We take reasonable care over website content and security, but availability may be interrupted for maintenance or reasons outside our reasonable control. General illustrations are not personalised loan offers. Tell us about an error or discrepancy so we can address it. This clause does not excuse misleading information or failures to provide required disclosures.
9 Responsibility for misuse
9.1 You may be responsible, to the extent permitted by law, for direct and reasonably foreseeable loss caused by your fraud, unlawful misuse of the website or material breach of these Terms. We must establish the basis and amount of any claim and take reasonable steps to reduce loss.
9.2 You are not required to indemnify us for our own fault, for making a complaint in good faith or for exercising a legal right. Legal and recovery costs are governed by section 13 and applicable law.
10 Changes to terms and services
10.1 Website terms
We may update these Terms to reflect changes to the website, our services or legal requirements. We will display the revised version date and give appropriate notice of material changes.
10.2 Existing loans
A website update or continued use of the website does not vary an existing loan, introduce new fees, change its interest rate or remove an accrued right. Changes to a credit agreement require the process, notices and any consent required by that agreement and applicable law.
10.3 Product availability
We may change or withdraw products for future applications. We remain responsible for commitments under existing agreements.
11 Governing law and jurisdiction
11.1 These Terms are governed by Gibraltar law. Disputes may be brought before the courts of Gibraltar, subject to any mandatory rights concerning applicable law, jurisdiction or available remedies. This clause does not prevent a complaint to a competent regulator or other available dispute resolution body.

13 Debt collection and electronic communication
13.1 Recovery action
If sums lawfully due remain unpaid, we may take proportionate recovery action ourselves or instruct a collection agent or legal adviser. We will comply with applicable notice requirements and consider information about financial difficulty or a genuine dispute before deciding the appropriate next steps.
13.2 Assignment
We may transfer rights under a credit agreement where permitted. If a transfer requires written notice, we will provide it. Any statutory exception applies only where its conditions are met. A transfer does not remove any defence or right of set-off you can lawfully exercise.
13.3 Recovery costs and data
We may seek recovery costs only where legally recoverable and consistent with the agreement, including any court assessment or order required. Engaging an agent does not automatically make you liable for every fee it charges us. Information sharing for recovery must be lawful, necessary and consistent with our Privacy Policy.
13.4 Electronic account communications
Where electronic delivery is agreed and legally permitted, we may send agreements, statements, reminders and other account information by email or another agreed electronic method. Where the law requires a durable medium, we will use a suitable format that you can retain. Tell us promptly if your details change or you cannot access a document, and contact us about available alternative formats.
13.5 Receipt and legal documents
Sending an email does not, by itself, establish that you received it. The effectiveness and timing of notices depend on the applicable agreement, law and evidence of delivery. Service of court proceedings must comply with the relevant procedural rules and any necessary consent or court order; these website Terms do not deem every emailed document validly served.
14 Severability
14.1 If a provision is invalid or unenforceable, it will not bind the parties to that extent. The remainder continues only where it can operate lawfully without that provision. This does not authorise us to replace an unfair term with a more burdensome one.
15 Complaints and disputes
15.1 Raising a concern
Contact us using section 12 if you have a concern about an application, retailer introduction, explanation, charge or repayment. Please provide your name, loan reference if known, the issue and the outcome you seek. Supporting records help, but a complaint is not automatically rejected because you do not have them.
15.2 Our review
We will acknowledge and investigate complaints, consider relevant customer and retailer evidence, keep you informed and explain our findings in writing. Where a complaint concerns the sale of finance, we will consider the information and opportunity to review provided before signing. A signature or the passage of time will not, on its own, determine the outcome; applicable legal time limits remain relevant.
15.3 Further options
Our response will explain any applicable escalation or external redress route. Nothing in these Terms prevents you from seeking independent advice, contacting a competent regulator or exercising a legal remedy.
